End of Life Policy

Eaton is committed to delivering the most innovative and cost-effective Software to our customers. Therefore, Eaton may choose to discontinue Software or Versions of Software and related services periodically for a variety of reasons, including:

  • new and improved feature sets;
  • market or customer changes;
  • technological innovations;
  • low customer demand for the software;
  • software obsolescence; and
  • security issues.

 

At Eaton’s sole discretion, software and related services, including on-premises software, hosted software, and software as a service (“Software”), may be discontinued regardless of the delivery method.  The Software Guidelines provided by this policy will help customers and partners to better manage their Software end-of-life transitions and understand the role that Eaton can play in helping to migrate to alternative Eaton Software

Definitions

“Version End-of-Life Date” means the date on which Eaton (i) no longer makes available a specific Version of Software but continues to make available new Versions of the Software for sale and (ii) ceases to provide Software development, maintenance, installation and configuration assistance, technical support, and all other services for the specified Version.

“Software End-of-Life Date” means the date on which Eaton withdraws all Versions of the specified Software from the market.

“Replacement Software” means new Software that Eaton, in its sole discretion, may offer for sale as a replacement for Software that is scheduled for retirement.

“Version” means each major release (1.x.x) and each minor release (x.1.x) of the Software. A patch release is not a new version of the specified Software (x.x.1). 

Software Guidelines

Eaton reserves the right to treat each Software independently. Eaton also reserves the right to change these Software Guidelines at any time without notice. The Software Guidelines are as follows:

  1. Eaton will use commercially reasonable efforts to provide customers with notice of the affected Software's Version End-of-Life Date and/or Software End-of-Life Date by updating the End-of-Life Schedule (below).
  2. Version End-of-Life and Software End-of-Life determinations will be made on a Software-by-Software basis at the sole discretion of Eaton.
  3. Generally, Eaton will not patch or otherwise support any Version that is more than three (3) versions older than the most current Version. If Eaton releases more than three (3) Versions in any twelve (12) month period, Eaton will provide support for all Versions released in the prior twelve (12) months.
  4. Generally, Eaton offers technical support for the Software as set forth in Eaton’s Brightlayer Support Schedule.
  5. For Software that requires a valid support or subscription entitlement to obtain technical support, a customer must provide evidence of a valid and continuous support or subscription entitlement from the initial purchase date to receive such support. 
  6. Issue resolution or enhancement requests will be provided at Eaton’s sole discretion and may require one or more Software upgrades.

Any questions arising in the interpretation of this policy or the application of this policy shall be determined by Eaton in its sole discretion.
